1. Purpose and Scope

These Terms and Conditions of Use (hereinafter "Terms" or "T&C") govern the access to and use of the services provided through the Trezio platform, owned and operated by FCTU SA (hereinafter "the Company", "we", "us", or "our"), a company incorporated under Swiss law with its registered office at 123 Route de Meyrin, 1219 Châtelaine, Geneva, Switzerland.

Trezio is a digital platform that transforms physical spaces into gamified experiences through interactive scavenger hunts. Our services are available via our website (trezio.io), Android application, and iOS application (collectively, the "Platform").

These Terms apply to all users of the Platform, including individual users ("Players" or "Customers") and business partners ("Business Users" or "Partners"), whether accessing free or paid features.

By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform.

2. Definitions

For the purposes of these Terms:

  • "Trezio" refers to the platform and services operated by FCTU SA, accessible via web, Android, and iOS applications.
  • "Scavenger Hunt" refers to any gamified experience, adventure, or interactive activity available on the Platform, including but not limited to location-based puzzles, quests, and challenges.
  • "Venue" refers to physical locations where Scavenger Hunts take place, including shopping malls, museums, cultural institutions, tourism sites, and other participating establishments.
  • "Player" or "Customer" refers to any individual who uses the Platform to participate in Scavenger Hunts.
  • "Business User" or "Partner" refers to any business entity or representative that partners with FCTU SA to host Scavenger Hunts at their Venue or access business analytics features.
  • "Account" refers to the user profile created on the Platform, which may be used for Customer access, Business access, or both.

3. Account Registration and Eligibility

3.1 Age Requirements

The Platform is intended for users aged 13 and older. By creating an Account, you confirm that you meet the applicable age requirements:

  • Users aged 16 or older may create and use an Account independently.
  • Users aged 13 to 15 may only create an Account with verifiable parental or legal guardian consent. By permitting a minor to use the Platform, the parent or guardian agrees to these Terms on behalf of the minor and accepts responsibility for the minor's use of the Platform.
  • Users under 13 are not permitted to create an Account or use the Platform.

3.2 Account Creation

When registering, you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your Account. You must notify us immediately at contact@fctu.io if you suspect any unauthorized use of your Account.

3.3 Account Types

A single Trezio Account may be used to access both Customer features (participating in Scavenger Hunts) and Business features (accessing venue analytics and data), depending on the permissions granted to your Account.

4. Services Description

4.1 For Players/Customers

Trezio provides access to interactive Scavenger Hunts at participating Venues. Features may include location-based riddles, augmented reality (AR) experiences, puzzles, and challenges. Some Scavenger Hunts are free, while others require payment.

4.2 For Business Users/Partners

Business Users may access analytics and data related to Scavenger Hunts at their Venues, including number of hunts completed and revenue data. The Platform is provided free of charge to Business Users. Scavenger Hunt content is currently created by FCTU SA on behalf of Partners.

4.3 Rewards and Competitions

The Platform may offer rewards in the form of digital badges, coupons, discounts, or participation in skill-based competitions. All competitions are based solely on skill (e.g., fastest completion time, highest score) and not on chance. Specific rules for competitions will be published on the Platform prior to each competition.

5. Permissions and Technology

The Trezio mobile applications are built using Unity and may request access to the following device features:

  • Camera: For augmented reality (AR) features and scanning QR codes.
  • GPS/Geolocation: For location-based riddles and verifying your presence at Venues.
  • Bluetooth/BLE: For proximity-based triggers and interactions within Venues.
  • Push Notifications: To send you updates, alerts, and information related to Scavenger Hunts and your Account.

6. Acceptable Use

By using the Platform, you agree not to:

  • Use the Platform for any illegal, fraudulent, or unauthorized purpose.
  • Attempt to disrupt, compromise, or interfere with the Platform's security, servers, or networks.
  • Access or attempt to access restricted areas of the Platform or its underlying systems.
  • Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Platform.
  • Cheat, manipulate, or exploit any bugs or vulnerabilities to gain unfair advantages in Scavenger Hunts, leaderboards, or competitions.
  • Share, sell, or transfer your Account credentials to third parties.
  • Engage in any conduct that could damage, disable, or impair the Platform or interfere with other users' enjoyment.

7. Payments, Pricing, and Refunds

7.1 Pricing

Prices for paid Scavenger Hunts are displayed on the Platform in Euros (EUR) or Swiss Francs (CHF), inclusive of applicable taxes. Prices may vary by Venue and experience.

7.2 Payment Methods

Payments for Scavenger Hunts are currently processed on-site at participating Venues via QR code. We accept payment methods available at the Venue. FCTU SA does not store credit card information.

7.3 Refund Policy

Refund requests may be submitted within 14 days of purchase, provided the Scavenger Hunt has not been started. Refunds are granted at FCTU SA's discretion and are primarily available for technical issues that prevent access to or completion of the purchased experience. To request a refund, please contact us at contact@fctu.io with your purchase details.

7.4 Revenue Sharing

For paid Scavenger Hunts at Partner Venues, revenue is shared between FCTU SA and the Venue Partner. The standard revenue share is 50% FCTU SA / 50% Partner, subject to individual contractual agreements.

8. Intellectual Property

All materials and technology associated with the Platform—including but not limited to software code, scripts, images, graphics, logos, UI elements, 3D models, AR content, puzzles, riddles, narratives, trademarks, and the "Trezio" brand—are the exclusive property of FCTU SA or its licensors.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes in accordance with these Terms. Unauthorized reproduction, distribution, modification, or commercial exploitation of any Platform content is strictly prohibited.

9. Analytics and Cookies

The Platform uses the following analytics tools to improve our services:

  • Google Analytics 4 (GA4)
  • Firebase Analytics

10. Personal Data and Privacy

FCTU SA is committed to protecting your privacy and complies with the General Data Protection Regulation (GDPR) and Swiss data protection laws. We collect and process personal data only as necessary to provide our services.

Data we may collect includes identity information (name, email), device data (IP address, browser, device ID), gameplay interaction data, geolocation data (upon consent), and transaction data.

11. Limitation of Liability

11.1 Service Availability

FCTU SA strives to provide uninterrupted access to the Platform but does not guarantee 100% uptime. The Platform is provided "as is" and "as available."

11.2 Exclusions

To the maximum extent permitted by applicable law, FCTU SA shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages.
  • Loss of data, profits, revenue, or business opportunities.
  • Service disruptions due to network outages, third-party failures, or circumstances beyond our reasonable control.
  • Physical injuries or accidents occurring during participation in Scavenger Hunts at Venues. Users participate at their own risk and should remain aware of their surroundings.

11.3 Force Majeure

FCTU SA shall not be liable for any delay or failure to perform resulting from events beyond our reasonable control, including natural disasters, pandemics, cyberattacks, government actions, or other force majeure events.

11.4 Maximum Liability

In any event, FCTU SA's total aggregate liability shall be limited to CHF 100 or the total amount paid by you to FCTU SA in the 12 months preceding the claim, whichever is greater.

12. Third-Party Platforms

12.1 Apple App Store

If you download or use the Trezio iOS application from the Apple App Store, you acknowledge and agree that:

  • These Terms are between you and FCTU SA only, not with Apple Inc.
  • Apple has no obligation to provide maintenance, support, or warranty services for the application.
  • FCTU SA, not Apple, is responsible for addressing any claims relating to the application, including product liability, legal compliance, or intellectual property claims.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12.2 Google Play Store

If you download or use the Trezio Android application from the Google Play Store, you acknowledge and agree that:

  • These Terms are between you and FCTU SA only, not with Google LLC.
  • Google has no obligation to provide maintenance, support, or warranty services for the application.
  • FCTU SA, not Google, is responsible for addressing any claims, support requests, or issues relating to the application.

13. Confidentiality (Business Users)

Any confidential information exchanged between FCTU SA and its Business Users or institutional Partners shall be subject to mutual confidentiality obligations. Unless otherwise agreed in writing, confidentiality obligations remain in effect for three (3) years after the end of the business relationship.

14. Account Termination

You may delete your Account at any time through the Platform settings or by contacting us at contact@fctu.io.

FCTU SA reserves the right to suspend or terminate your Account without prior notice if we reasonably believe you have violated these Terms, engaged in fraudulent activity, compromised Platform security, or otherwise acted in a manner harmful to other users or the Platform.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Switzerland and applicable European Union regulations, including the GDPR.

Any dispute arising from or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Geneva, Switzerland.

16. Modifications to Terms

FCTU SA reserves the right to modify these Terms at any time. Significant changes will be communicated via the Platform (website or application) with a minimum of fourteen (14) days' notice before taking effect. Your continued use of the Platform after such notice constitutes acceptance of the modified Terms.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the remaining provisions, which shall continue in full force and effect.
